1900 sickened: DeCosters appeal jail time in Salmonella egg case

Austin “Jack” DeCoster and Peter DeCoster were sentenced April 13, 2015 to three months in prison for introducing adulterated food into interstate commerce after eggs from their Iowa farms were linked to a 2010 national salmonella outbreak which sickened at least 1,900 people.

More than 1,900 people across the country reported getting sick from Salmonella enteritidis linked to tainted eggs supplied by Quality Egg. The companies recalled 550 million eggs nationwide.

Quality Egg pleaded guilty in June 2014 to bribing public officials and misbranding eggs to make them appear fresher.

The DeCosters’s sentences — especially the prison time — were viewed as a warning to other food producers.

Jack DeCoster, 82, of Turner, Maine, and Peter DeCoster, 52, of Clarion, are now trying to get out of their jail time. They filed an appeal April 27, 2015, asking the U.S. District Court of Appeals 8th Circuit to remove incarceration from their sentence.

“They’re arguing that, based upon the type of offense, any sentence of jail time is not appropriate,” Assistant U.S. Attorney Peter Deegan said last week.

Pro-business groups, including the Cato Institute and the National Association of Manufacturers, filed briefs in support of the DeCosters, arguing executives shouldn’t serve jail time for this type of crime.

“If executives can be imprisoned for criminal violations of strict liability laws by virtue of the position they hold within a company, the United States economy would suffer,” attorneys for Cato and the manufacturing association argued. “Executive business decisions would be motivated less by good business principles and more by fear of possible future prison sentences.”

The 8th Circuit heard oral arguments in the appeal March 17 in St. Paul, Minn., and the parties are now waiting for a decision.

Who knows it’s all marketing BS: Where did your egg come from?

Every industry has a few bad eggs. For the egg industry, it was DeCoster Egg Farms. In 2010, DeCoster was harboring foul cages full of sick hens.

The eggs were broken into skillets, whisked into mayonnaise, and ended up sickening as many as 6,200 Americans in what would become the largest egg recall in U.S. history. The U.S. Department of Agriculture and the Food and Drug Administration quickly passed laws to reform egg safety—but not before consumers had seen the crack in the industry’s veneer.

TEN Ag Tech, a Southern California–based startup aims to take the existential crisis out of your egg purchase. The tech company seeks to keep the egg industry accountable in two ways. First, it offers mobile-based apps that increase transparency on farms by monitoring human behavior—i.e., keeping track of who enters and leaves a hen house. Second, it engraves each individual egg with its own (nontoxic, naturally) gold laser barcode. Input that barcode onto the Naturally Smart Egg website, and you’ll instantly know everything about that egg’s origins: the breed of hen that laid it, the production method that spawned it (cage-free, traditional caged production, or free-range), and the moment it was packed within 180 seconds.

If this is all beginning to sound like a certain Portlandia skit—you know, that one where the couple interrogate their waitress about Colin, the chicken they will be enjoying—then you’re on the right track.

 It’s that, plus data. TEN Ag Tech seeks to “reconnect consumers to the farms that feed them,” according to its website. Since last July, consumers have been buying the company’s Naturally Smart eggs on the shelves of Chicago’s high-end Mariano’s grocery stores, a division of Kroger.

TEN Ag Tech’s vision is not limited to eggs: In February, the company will debut its traceable technology for coffee and meat. The goal is to prevent foodborne illness debacles like the recent outbreaks at fast-casual chain Chipotle. “As monoculture grows, companies like Chipotle are creating alternative realities, fresh food, local foods coming from local places,” says Jonathan Phillips, the company’s president and CEO. “The question is: When you’re dealing with 40,000 farms, how on Earth do you ensure that they’re all producing food for you safely? Our tech begins to solve that problem.”

But when it comes to helping us avoid outbreaks in the first place, this kind of data may be useless, says Ken Anderson, a poultry-extension specialist at North Carolina State University who focuses on egg processing, production, and safety. That’s because in most cases, contamination takes place after the production process, whether in a grocery store, a restaurant, or in your own kitchen. “It’s workers at a grocery store. It’s consumers opening up the egg cartons. It’s people transferring eggs to plastic cartons in their fridge,” says Anderson. “Those little things all add up and add a potential for contamination totally separate from how the eggs were produced.”

Egg moguls belong behind bars

The Des Moines Register writes in this editorial that four months ago, Iowa egg producers Austin “Jack” DeCoster and his son, Peter, were each sentenced to 90 days in prison for their role in the nation’s largest egg-related Salmonella outbreak.

decosterNow, however, the Chamber of Commerce of the United States, the National Association of Manufacturers and other major business organizations are fighting to keep the DeCosters out of prison.

They’ve filed briefs with the Eighth Circuit Court of Appeals, siding with the DeCosters in arguing that while fines and probation are acceptable in such cases, it’s unconstitutional to put corporate executives behind bars for the criminal actions of their underlings.

It’s an interesting case with major legal and ethical implications. After all, mere fines aren’t much of a deterrent to executives who collect multi-million-dollar salaries. But a 90-day stint in prison, as the DeCosters themselves argue in their court filings, carries with it the “personal loss and stigma” associated with becoming a convict.

In this case, a prison sentence certainly seems warranted. The Quality Egg salmonella outbreak of 2010 sickened at least 56,000 people (about 1,800 confirmed) and triggered a record-setting recall of more than half a billion eggs.

salmonella.eggsAs to whether the DeCosters themselves were to blame for the outbreak, U.S. District Court Judge Mark Bennett found the two men had created a “culture of rampant safety violations” and a “work environment where employees not only felt comfortable disregarding regulations and bribing USDA officials, but may have even felt pressure to do so.”

The editorial conclueds that tens of thousands of people were sickened as a direct result of the manner in which the DeCosters managed — or, rather, mismanaged — Quality Egg and its employees. For that, the DeCosters should be held accountable. A prison sentence is entirely appropriate.

He’s baaaaack: DeCoster to buy Maine egg producer

A farm executive who pleaded the Fifth Amendment against self-incrimination in front of a congressional committee investigating an Iowa salmonella outbreak is the same person who signed a new lease on Maine’s largest egg farm last month.

decosterThe Maine Department of Environmental Protection is considering a request by a Land O’Lakes subsidiary to transfer active permits to Hillandale Farms, which was involved with Jack DeCoster (right, pretty much as shown) in the Iowa salmonella outbreak that sickened 1,900 people in 2010, the Sun Journal reported.

Hillendale, an egg producer headquartered in Pennsylvania, signed a lease to operate the farms on July 8. But the properties continue to be owned by DeCoster’s corporate entities, the newspaper said.

A University of Maine veterinarian who sits on a salmonella risk reduction team for the state says Moark, a subsidiary of Land O’Lakes, had been “terrific” to work with. She hopes for the same with Hillandale.

“We are vitally interested in the health of Maine people (and) we want our state to have a poultry industry as well,” said Anne Lichtenwalner, director of UMaine’s Animal Health Lab. “We want transparency and we want collaboration, and I think that they are walking into a positive situation. One hopes that they embrace that.”

Moark signed its lease over to Hillandale Farms Conn LLC on July 8. That agreement was signed by Hillandale President Orland Bethel, who in 2010 pleaded the Fifth in front of the Congressional Energy and Commerce Committee when he and DeCoster were asked to testify about the salmonella outbreak.

DeCoster’s company managed Hillandale’s Alden, Iowa, farm.

Stroke me, stroke you: Ex-Iowa egg farm manager avoids jail in 2010 Salmonella outbreak

A former Iowa egg farm manager will avoid jail time after cooperating with investigators in a criminal prosecution stemming from a 2010 salmonella outbreak.

egg.dirty.feb.12U.S. District Judge Mark Bennett sentenced Tony Wasmund to four years of probation Tuesday after the government said he provided “substantial assistance” in the salmonella case. Bennett imposed no restitution or fine on Wasmund, of Willmar, Minnesota.

Wasmund worked for egg tycoon Jack DeCoster, whose Iowa operations caused the outbreak that prompted the recall of 550 million eggs and sickened thousands.

Under a plea deal, Wasmund pleaded guilty in 2012 to his role in bribing a U.S. Department of Agriculture inspector to allow sales of eggs that didn’t meet federal standards. He cooperated in an investigation that led to convictions of DeCoster and his son Peter.

The pair were sentenced in April 2015 to three-month terms in prison for introducing adulterated food into interstate commerce.

Iowa editorial says egg conviction insufficient

At the hearing, U.S. District Court Judge Mark Bennett said the DeCosters “created a work environment where employees not only felt comfortable disregarding regulations and bribing USDA officials, but may have even felt pressure to do so.”

Given the magnitude of those crimes, and the tens of thousands of people who suffered as a result, the sentence that was handed down seems seriously lacking: The DeCosters were each fined $100,000 and sentenced to 90 days in jail, with a year of supervised release.

But the fact is, it’s not often that corporate executives are held criminally responsible for their companies’ actions, even when the nation’s food chain is poisoned. Most cases are resolved with corporate fines, and in this case the DeCosters’ Quality Egg had to pay almost $7 million in fines, restitution and forfeitures.

What’s more worrisome than the 90-day sentences is the fact that the DeCosters flouted federal regulations for years without ever being caught. The regulatory system that is supposed to prevent — not simply respond to — violations of food-safety regulations failed us completely. It wasn’t until consumers started becoming ill that investigators took any sort of meaningful action against the DeCosters.

According to federal authorities, the company deliberately and routinely provided false paperwork to an independent auditing firm that periodically inspected the plant and reviewed the company’s records to ensure the eggs were safe. On the eve of each impending audit, workers were given blank, signed audit forms and told to fabricate data for the reports. This went on for at least three years, at a time when the DeCosters were producing more than 1 million eggs per day.

For at least eight years, Quality Egg regularly shipped its customers eggs that were labeled with falsified processing dates and expiration dates to conceal the fact that the eggs were old. According to court records, this mislabeling of DeCoster eggs “was a common practice, and was well known among several Quality Egg employees.”

In 2010, federal inspectors conducted on-site visits to the company’s egg-laying facilities and feed mill. Inside, they found frogs; wild birds; a chicken skeleton; mice, beetles, maggots and flies; and manure that was piled to the rafters inside one building. Salmonella contamination was pervasive and widespread “throughout the entirety” of the Decosters’ Wright County egg operations.

On at least two occasions, Quality Egg officials bribed a USDA inspector to overlook regulatory violations — in one case, paying $300 from the company’s petty cash account.

Given the DeCosters’ long history of alleged regulatory violations related to salmonella outbreaks, the minimum wage, pollution, workplace safety, animal cruelty, child labor and the hiring of undocumented immigrants, government regulators should have been particularly vigilant in their oversight of this family’s Iowa operation. But they were not.

According to AP, the three-month sentences handed down in federal court are noteworthy because only a handful of cases of corporate misconduct end with executives behind bars (in the U.S.). The extent of harm caused by the outbreak and the pattern of problems led to the decision for jail time.

Austin “Jack” DeCoster and his son, Peter DeCoster, each faced up to a year in jail on misdemeanor charges for shipping adulterated food. They will remain free while appealing their sentences.

“There’s a litany of shameful conduct, in my view, that happened under their watch,” U.S. District Judge Mark Bennett said.

Prosecutors said the jail sentences send a strong message about the importance of following food safety rules.

“A sentence of imprisonment is a fairly significant sentence in a case like this,” said Peter Deegan, the assistant U.S. attorney who prosecuted the case.

No, it just shows how little the U.S. cares about food safety and the free reign to make people sick.

US wants egg executives punished for Salmonella outbreak

A judge should consider the “widespread harm” done by a major 2010 salmonella outbreak and the food safety lapses that preceded it in sentencing two egg industry executives whose company was responsible, prosecutors said Monday.

salmonella.eggsIn punishing them next week, U.S. District Judge Mark Bennett should consider that Austin “Jack” DeCoster and his son Peter ran a massive egg production operation that “routinely disregarded food safety standards and practices,” assistant U.S. Attorney Peter Deegan wrote in a sentencing memorandum.

Jack DeCoster, 80, of Turner, Maine, and 51-year-old Peter DeCoster, of Clarion, Iowa are scheduled to be sentenced April 13 by U.S. District Judge Mark Bennett in a federal courtroom in Sioux City, Iowa. Both pleaded guilty last year to introducing adulterated eggs into interstate commerce and face up to one year in jail.

Under the terms of the plea agreement, prosecutors did not ask for a specific term of jail, home confinement or probation. But the 14-page memo outlined illegal and unethical food safety practices that repeatedly happened on their watch, and argued the sentences should send a message to other corporate executives to “act responsibly when it comes to food safety.”

The DeCosters and their company, Quality Egg, knew that their Iowa egg facilities were at risk for contamination long before the 2010 outbreak, which sickened thousands, Deegan argued.

How would consumers know? Iowa too has an egg problem

Four years ago, Iowa was the focus of unwanted national attention triggered by an outbreak of Salmonella Enteritidis that sickened at least 1,800 people and led to the largest egg recall in United States history — more than 500 million eggs.

Since then, not one of the proposed reforms has been enacted.

Federal investigators attributed the 2010 outbreak to the Iowa operations of Austin “Jack” DeCoster, whose company eventually agreed to pay $6.8 million in fines for attempting to bribe a U.S. Department of Agriculture inspector and for selling old eggs with false labels.

DeCoster and his son, Peter, have each agreed to pay $100,000 in fines. They are now awaiting sentencing on criminal charges of introducing tainted eggs into the nation’s food supply.

The DeCoster case perfectly illustrates why states must be vigilant in regulating their most important industries — particularly when the public health is at stake.

In the late 1980s and early 1990s, DeCoster eggs that were produced in Maine and Maryland were linked to a series of salmonella outbreaks, including one in New York that killed nine people and sickened hundreds more.

New York eventually banned DeCoster from selling his eggs in that state, and Maine and Maryland imposed a variety of restrictions on his business. DeCoster complained about the expense associated with this new regulatory oversight and sold his Maryland operation. He focused his business on Iowa, the nation’s No. 1 egg-producing state, which had no state-imposed requirements for salmonella monitoring.

Even after the federal reforms were enacted, Iowa egg producers were still given advance notice of government inspections. In some cases, the companies dictated the date of their inspections. The egg producers also were allowed to continue to keep secret from inspectors the brand names under which their eggs were sold. They also withheld access to their complaint files and even refused to name company employees. Even now, egg producers are not required to notify state regulators when salmonella is found in their eggs and barns.

eggsalmonellaIn June, 2014, Austin “Jack” DeCoster, 79, and Peter DeCoster, 50, agreed to pay $7 million in fines and forfeitures as part of a federal criminal case.

Prosecutors allege Quality Egg on at least two occasions in 2010, including April 12, 2010, offered money to a “public official with intent to influence an official act.”

On April 12, 2010, Quality Egg employees offered a USDA inspector $300 to release eggs for sale that had failed to meet federal standards, according to criminal charges filed in 2012 against Tony Wasmund, a former Quality Egg employee.

Wasmund, 63, of Willmar, Minn., pleaded guilty in September 2012 to conspiring to bribe an egg inspector. His sentencing has been rescheduled four times, leading to speculation prosecutors were using his testimony against the DeCosters.

Today, the U.S. Attorney’s Office for the Northern District of Iowa asked anyone from the public who got sick from the DeCoster- Salmonella eggs to come forward.

Anyone sickened by those eggs or otherwise hurt by the incident has the right to submit a Victim Impact Statement during the sentencing phase to explain how the crime affected them physically, emotionally or financially.  Impact Statements can be submitted online at www.justice.gov/usao/ian.
